These Terms of Service ("Terms") govern your use of the OnlyFaxes website and services ("Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Service Description

OnlyFaxes provides an online facsimile transmission service. The Service allows users to send faxes via the internet. We also offer optional paid subscriptions for dedicated fax numbers with additional features. The free tier requires no account registration.

2. Acceptable Use

You agree not to use the Service to:

Transmit unlawful, harassing, defamatory, or fraudulent content
Send unsolicited bulk faxes (spam) or violate the Telephone Consumer Protection Act (TCPA)
Transmit content that infringes on intellectual property rights
Attempt to interfere with or disrupt the Service or its infrastructure
Use the Service for any purpose that violates applicable laws or regulations

We reserve the right to suspend or terminate access to the Service at our sole discretion if we believe you are violating these Terms.

3. No Guarantee of Delivery

While we strive for reliable fax delivery, we do not guarantee that every transmission will be successfully received. Fax delivery depends on factors outside our control, including the recipient's fax machine, phone line quality, and network conditions. The Service is provided on a best-effort basis.

4. Privacy and Data Handling

Your use of the Service is also governed by our Privacy Policy. All user data, including uploaded documents, email addresses, and phone numbers, is automatically deleted after 90 days for free-tier users. Dedicated number subscribers retain fax history for the duration of their subscription.

5. Subscriptions and Billing

Dedicated fax number subscriptions are billed monthly through our payment processor, Stripe. By subscribing, you authorize recurring monthly charges until you cancel. You may cancel at any time through your account settings or by contacting support. No refunds are provided for partial billing periods.

6. Intellectual Property

The Service, including its design, logos, and software, is the property of OnlyFaxes and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our prior written consent.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONLYFAXES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

9. Indemnification

You agree to indemnify and hold harmless OnlyFaxes and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to your use of the Service or violation of these Terms.

10. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Delaware.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
